An artist who put illuminated 'I heart New York' bags around New York City will be held behind bars for a month-long mental evaluation after police mistook his public art project for planting bombs.

At a court appearance on Sunday, Brooklyn Criminal Court Judge Martin Murphy ordered Mr Miyakawa to undergo a psychological test and be held in jail for a month until experts can examine him.

'The judge didn't state his reasoning for holding him for mental health evaluation,' she said.

Ms Blum said she was planning to file an emergency petition, seeking her client's immediate release.

Mr Miyakawa was born in Japan, but moved to New York in 1989. He has a furniture design studio in the Greenpoint neighborhood of Brooklyn.

Among his current works is a chest of drawers called 'Affordable Housing,' which is shaped like a public house apartment complex.
